期货居间人的相关问题及对策研究

中文摘要：在当前世界各国的金融期货市场上，近年来期货居间人期货居间
人市场迅速的发展，他们居于期货经纪商与客户之间，从事招揽客户的活动，
并成为市场主体中非常重要和活跃的一部分，并且对我国期货市场起到了积
极的推动作用。但是由于我国期货市场不完善，加之期货法律法规的不健全，
期货居间人引发的期货风险包括诱骗客户进行期货交易、代替客户签订虚假期
货经纪合同、夸大或虚构交易业绩诱导客户出资、全权代理客户交易而恶性炒
单等情形，所以加强期货市场的监管非常必要。本文对期货居间及相关法律关
系进行了分析，并根据我国期货市场的具体情况，提出了完善期货居间人市

Abstract ： In the current world financial futures maket.There are generally kind of 
intermediary   group.Their   futures   brokerage   in   between   customers   engaged   in   the 
activities of the solicit customers. And be in the market main body is very important 
and active part .There are we say normally “broker”.In recent years ,Futures broker 
market the rapid development , has become a futures market the indispensabie part 
in . And for our futures market plays a positive role in promoting this . But because

’s futures market is not perfect , the futures of laws and regulations is not 

sound . Futures broket triggered futures risk including lure customers futures trading , 
instead of false clients to sign a contract of futures brokerage ,exaggerated or fictional 
induction   customer   investment   ,   trade   performance   acted   solely   for   customer 
transanction and single case of malignant fry . So to strengthen the supervision of the 
futures market is very necessary . In this paper , the futures brokerage and related 
legal relation analysis . And according to the specific situation of our futures makets , 
put forward the futures broker some suggestions of the market .

随着我国加入 WTO 和全球经济一体化进程的加快，期货市场作为重要的

风险管理工具，在国民经济中的作用日益重要，由于期货交易活动比较复杂、
专业性强、涉及环节多，大多数投资者主要通过各种期货中介，尤其是期货居
间人进入市场，这也是市场专业分工的规律所决定的。

善，期货居间人引发了各种纠纷和风险事件，对期货行业的发展造成了严重
的不良影响，而在期货市场进入规范发展的今天，期货居间人制度的缺位，
又成为制约期货行业发展壮大的重要障碍，因此探索和建立一套符合我国国
情的期货居间人制度势在必行。
